No. Your right to live in the home (the Usufruct) is a life-long legal right registered at the Land Registry. Even if the investor sells their "Bare Ownership" to someone else, your right to stay remains untouched and protected by Spanish law.
Usually, you continue to pay for what you consume (electricity, water, etc.) and the basic maintenance. The investor often takes over the "big" costs like the IBI (Property Tax) and major structural community assessments (derramas). This is all clearly defined in the Notary deed.
If you decide to leave the property, you can often "rent out" your usufruct to someone else to help pay for your care, or in some cases, we can negotiate a final buyout with the investor to give you a closing lump sum.
They will not inherit the property itself, but they will inherit the cash you released. Many of our clients find it better to give their children an inheritance now, when they actually need it for mortgages or education, rather than decades later.
This is known as "longevity risk." We mitigate this by using professional actuarial tables to price the deal correctly at the start. For larger investors, building a portfolio of properties (up to €10M) spreads this risk; statistically, the "early" completions balance out the "late" ones.
Yes. You own the "Bare Ownership" (Nuda Propiedad). It is a tradable asset. If you need liquidity, you can sell your deed to another investor. In a rising market, you may even turn a profit on the sale without ever having taken possession.
The usufructuary is legally required to maintain the property in "good condition." Because it has been their home for years, they usually take excellent care of it. Furthermore, our legal contracts allow for periodic inspections to ensure the asset's value is preserved.
Spanish tax on Nuda Propiedad is calculated based on the age of the usufructuary. Our in-house tax team structures the purchase to ensure you are utilizing all available deductions and that the eventual "consolidation of domain" (when you get full ownership) is handled as cost-effectively as possible.
